2. Proprietary Metrics Ownership: Establishing that while box scores are public, proprietary algorithmic metrics (e.g., True Shooting %, usage rates) mathematically calculated by Tappa are intellectual property.
3. No Warranty on Data Accuracy: Formally waiving liability for statistical inaccuracies flowing from external official federation sources (FIBA, BFI) where human scorekeeping errors may exist natively.
4. Display Rights of Public Records: Asserting the legal right under fair use and public interest to index and display publicly recorded athletic performances and tournament rosters.
5. Indemnification for Third-Party Data: Holding the platform harmless if data ingested from public domains structurally leads to defamation claims from players based on poor statistical performances.
6. Non-Commercial End-User Restriction: Mandating that standard platform access is for personal use only, expressly forbidding rival scouting agencies from monetizing or white-labeling Tappa data.
7. Reverse Engineering Ban: Prohibiting unauthorized technical attempts to reverse-engineer the Next.js API endpoints or the Python ETL data pipeline schemas.
8. License to Platform UI/UX: Reserving full copyright ownership over the visual design, interactive elements, and structural code architecture of the web platform inherently.
9. DMCA / Copyright Takedown Protocol: Establishing a formal notice-and-takedown channel for third parties to request the removal of copyrighted media inadvertently scraped or uploaded.
10. Third-Party Trademarks Disclaimer: Explicitly stating no official commercial affiliation with FIBA, India Basketball, or specific clubs, acknowledging their respective trademark sovereignty natively.
Section 2: User Generated Content & Profile Claims
11. Profile Verification Authenticity: Requiring users claiming a profile to attest under penalty of perjury that they are the legal owner or authorized representative of that athletic identity.
12. Right to Revoke Verified Status: Reserving the absolute right to unilaterally terminate "Verified" badges without warning if fraudulent verification proofs are discovered.
13. License to Display Uploaded Media: Requiring players claiming profiles to grant Tappa a non-exclusive, royalty-free, perpetual license to host and distribute their uploaded profile photography.
14. AI-Generated Consistency Authorization: Explicitly authorizing the platform to utilize AI tools to digitally enhance, crop, or standardize uploaded photography for aesthetic platform conformity.
15. Unlawful Content Prohibition: Forbidding the upload of defamatory, explicitly explicit, or technically dangerous material (malware) through the claim modal proof links natively.
16. Account Transferability Ban: Prohibiting the sale or transfer of verified Tappa player accounts to third parties mechanically.
17. UGC Liability Exemption (Section 79 IT Act): Asserting "Safe Harbor" protections, declaring Tappa acts as an intermediary and holds no liability for what users write in their connected external social media bios.
18. Social Media Link Severability: Disclaiming all liability regarding the availability or content hosted on external URLs (Instagram/X) provided by the player structurally.
19. Deepfake & Deceptive Media Prohibition: Strictly forbidding users from uploading highly manipulated digital photography designed to deceive platform administrators during the claim verification pipeline.
19b. Social Media Scraping Authorization: By claiming a profile or interacting with the platform, players explicitly grant Tappa, its administrators, and associated pages the right to scrape, index, and feature publicly available content involving the player from all or any social media apps/websites (including but not limited to Instagram, X/Twitter, Facebook, YouTube, TikTok, and LinkedIn) to increase both the player's and the platform's visibility. Furthermore, in the event of any third-party copyright or platform dispute regarding the use of this social media content, the player agrees to take Tappa's side, actively ensure the dispute is resolved in Tappa's favor, and guarantee that Tappa can continue to use their content uninterrupted.
Section 3: Financial, Advertising & NIL
20. NIL Revenue Waiver: Explicitly stating that a player claiming a profile does not entitle them to compensation, revenue-sharing, or royalties derived from platform web traffic or analytics.
21. Platform Monetization Rights: Asserting Tappa’s unlimited right to introduce banner advertisements, corporate sponsorships, and scouting tools natively alongside player statistics.
22. Future Paywall Transition Rights: Reserving the explicit right to legally migrate previously free statistical arrays or features behind a premium subscription tier without prior warning natively.
23. No Revenue Sharing Agreements: Formally disclaiming any implied financial partnerships with athletes simply because their historical data generates platform value computationally.
24. Endorsement Disclaimers: Specifying that the listing of a player on Tappa does not legally constitute an endorsement of the athlete's personal conduct by the platform.
25. Liability for Third-Party Ads: Waiving platform liability regarding false claims or malicious external routing originating from third-party ad networks eventually integrated into the site.
26. Limitation of Damages Cap: Capping the maximum allowable financial damages a user can extract from Tappa in civil court strictly to the amount paid by the user in the prior 12 months, or $100 (whichever is lower).
27. Refund Policy Exclusion: Establishing an explicit "No Refunds" legal parameter for any future digital purchases or premium verifications natively mapped inside the structure.
28. Assumption of Risk: Users explicitly acknowledge the inherent risks of making their athletic metrics and web-handles easily discoverable on a centralized platform.
29. No Agent Representation: Tappa explicitly disclaims operating as a scouting or management agency for the athletes natively tracked on the platform.
Section 4: Technical Operations & Infrastructure
30. Service Level Agreement (SLA) Waiver: Providing platform services strictly on an "as-is" and "as-available" basis, legally waiving any guarantees of 99.9% uptime.
31. Feature Deprecation Rights: Reserving the absolute right to physically delete, modify, or sunset platform features permanently without providing liability or compensation to impacted users.
32. Temporary Suspension for Maintenance: Legal authorization to forcefully suspend platform access periodically to process raw Python database ETL pipeline synchronizations locally.
33. Beta Testing Designation: Explicitly designating newly pushed structural features inherently as "Beta Software" to structurally nullify liability for data corruption or software crashing implicitly.
34. Denial of Service (DoS) Self-Defense: Authorizing Tappa to actively block heavily-trafficked user profiles natively if they inadvertently trigger systemic Serverless Denial of Service architectures dynamically.
35. API Rate Limiting Enforcement: Retaining the explicit right to throttle or temporarily IP-ban entities aggressively polling the open serverless endpoints iteratively.
36. Sub-processor Exemption: Officially waiving liability if catastrophic hardware failures objectively originate within deeply embedded tier-3 infrastructure sub-processors (like AWS).
37. Platform Force Majeure: Freezing all liability computationally if standard operations cease due to prolonged internet outages, civil unrest, or catastrophic natural grid failures affecting India.
Section 5: Legal Dispute & Resolution
38. Binding Arbitration Requirement: Mandating that any and all disputes structurally bypass the standard civil court system and resolve exclusively through binding legal arbitration.
39. Class Action Lawsuit Waiver: Forbidding users from participating in or organizing consolidated class-action lawsuits directly against Tappa organically.
40. Governing Law: Establishing the exclusive physical legal jurisdiction specifically corresponding to the courts of Surat, Gujarat, India.
41. Severability Clause: Ensuring that if a judge strikes down any individual clause in the Terms mathematically, the remaining clauses physically stay entirely enforceable proactively.
42. Entire Agreement & Future Modifications: Defining this document mathematically as the ultimate superseding contract physically, and reserving the unilateral right to structurally amend its contents functionally with 30-days digital notice.
